Childish Gambino is reportedly being sued for copyright infringement over his song “This Is America”, according to BBC.

Emelike Nwosuocha, a rapper who performs under the name Kidd Wes, has alleged that the song has copied his track “Made in America”, which was released two years prior.

Nwosuocha has said in court documents that were filed in New York that the “lyrical theme, content, and structure” of both songs are “glaringly similar”.

Childish Gambino, or Donald Glover, has yet to respond to these allegations.

Back in 2019, “This Is America” made history by becoming the first rap track to win song of the year at the Grammy Awards. It became one of the most impactful songs of the year and discussed racial inequality, police brutality and gun violence.

However, Nwosuocha has claimed that the songs shared a “distinct and unique vocal cadence, delivery, rhythm, timing and phrasing’ and even noted how the choruses to both songs are written in the same metre. The rapper employed a musicologist who determined that the songs metre was likely not a coincidence.

Nwosuocha has demanded a trial and a damages for lost opportunities and profits.
